Businesses with employees are typically required to carry workers’ comp, unless they are in Texas or South Dakota. (Sometimes an owner-only business will also carry workers’ comp, but usually only to fulfill a contract requirement.)
But that’s just the hard-and-fast rule. There are many exceptions, and every state does it a bit differently. There are 2 surefire ways to find out if you’re required to carry workers’ comp:
- Check with your state’s workers’ comp bureau.
- Ask a licensed commercial insurance agent (ours are super friendly and knowledgeable!).
